Feds: Georgian took bribes for military machinery

By Christopher Seward

The Atlanta Journal-Constitution

Published: February 14, 2013

A South Georgia man who admitted to allowing more than $1 million in military equipment to be stolen from a base and then sold faces up to 15 years in federal prison, federal prosecutors said Wednesday.

Shelby C. Janes, 67, of Albany pleaded guilty to receiving about $98,500 in bribes for his role in the scheme, according to prosecutors.

Janes is a former civilian inventory control manager at the Marine Corps Logistics Base in Albany. The stolen equipment included cranes, bulldozers and front-end loaders. They ended up in the possession of a commercial trucking business that routinely did business with the base and arranged for the equipment to be sold to private buyers, prosecutors said.

The thefts targeted obsolete equipment returning from the Marine?s Fleet unit. The equipment was to be either sold or destroyed, or repaired and returned to the fleet. Prosecutors said Janes and another employee allowed equipment to be driven off the base and falsified documents authorizing the trucking business to take possession of the heavy machinery.

Janes, who appeared before U.S. District Judge W. Louis Sands in the Middle District of Georgia, pleaded guilty to one count of bribery of a public official. In addition to prison, he could face fines and he?s agreed to pay full restitution to the Defense Department, prosecutors said. A sentencing date has not been set.

Did The Indianapolis Mayor Endorse Echo's Technology?

On January 31, 2013 we published a research piece outlining our skepticism toward Echo Automotive (ECAU.OB), a company that claims to possess a technology that converts gasoline powered vehicles into plug-in electric/hybrids. ECAU now trades at around $1.10 after reaching a high of $3.61 on January 29, 2013. We believe the stock will soon break $1.00 to the downside.

As we have mentioned time and time again in past Pump and Dump ("P&D") articles, a successful pump is often tied to associations with "trustworthy people relationships" in order to help build an illusion of credibility. It appears as though ECAU is no exception.

In the days after we published our report, ECAU shares received a boost from the continued email campaign from the likes of Five Star Equities and The Bedford Report. The new talking point of the ECAU story, which attempts to convince investors into accepting its claims, centered on a test drive of one of ECAU's alleged converted vans by the Mayor of Indianapolis, Greg Ballard. It seems that ECAU has jumped all over this PR opportunity. Watch the Mayor of Indianapolis test-drive EchoDrive?.

A sensational quote from a Five Star email letter reads:

"Watch the Mayor of Indianapolis Test EchoDrive? to Rave Reviews"

Well, we've watched the Mayor's test-drive and he did seem to be entertained by his minute-and-a-half trip. But we think most investors will agree that his commentary was not a "rave review" of Echo's technology, nor does it infer that the city of Indianapolis is about to sign up for Echo's platform.

As we will discuss, the promotional email conveniently failed to mention that the Mayor is already in discussion with partners and major automakers. Furthermore, ECUA's "business plan" appears to be geared towards converting existing vehicles whereas it seems that the Mayor would like to purchase some of its new vehicles from established automakers. Finally, it seems that if the city of Indianapolis does choose to convert vehicles it will convert a good deal of its fleet vehicles to natural gas.

It is no secret that Mayor Ballard is championing the plight to reduce U.S. dependency on oil. On December 21, 2012 Mayor Greg Ballard signed Executive Order #6,

"requiring the city to replace its nearly 500 non-police sedans with electric or plug-in hybrid vehicles. New vehicles would be purchased as older ones are retired, and the city hopes to completely swap out its current 3100-vehicle fleet by 2025."

Here is some specific verbiage from the Mayor's December 21, 2012 press conference about the new bill. Around the 6:12 mark, he clearly states that:

"? our team is currently working with multiple automakers to have IMPD (Indianapolis Metropolitan Police Department), and the city of Indianapolis serve as technical advisors, test drivers, and eventually the proud users of the first plug-in hybrid police vehicle."

An article at Indystar.com does a good job outlining Mayor Ballard's proposals:

  • Requires the purchasing of electric or plug-in hybrid vehicles for non-police fleet use. The city fleet of approximately 500 non-police fleet cars will be replaced, as needed, saving taxpayers approximately $12,000 per vehicle over the ten-year life cycle of each car.
  • The city is currently working with partner organizations including Energy Systems Network and finance experts to convert the city's heavy fleet, including snow plows, trash trucks and fire apparatus to compressed natural gas ("CNG").
  • Finally, the city is seeking to partner with one or more automakers to develop a plug-in hybrid police vehicle that meets the safety, power, electronic and range needs of a modern urban police force. If a plug-in hybrid electric car could achieve just 40 MPG and meet the needs of police officers, city taxpayers would save up to $10 million per year. The city's current police vehicles average 10 MPG.

Considering the facts, we conclude that the odds that ECAU will play a meaningful part in the city's transformation process seem to be grossly over-exaggerated.

So here we go again. In our opinion ECAU is nothing but a pipe dream and will endure the same fate as all of the other P&Ds we have tracked, in a flop. Ultimately, we believe that it is likely that ECAU will follow the route of several of its president's past business ventures as detailed in the Seeking Alpha report published on February 7, 2013: Echo Automotive: The $155 Million Company Driven By Promotional Steam. Mayor Ballard may or may not be aware that his name and reputation are being used in what we believe to be a pump and dump game, but we assume that he will not be particularly ecstatic when he finds out.

Disclosure: I am short ECAU.OB. I wrote this article myself, and it expresses my own opinions. I am not receiving compensation for it. I have no business relationship with any company whose stock is mentioned in this article. (More...)

Jay-Z & Kanye West?s ?No Church In the Wild? Wins Best Rap/Sung Collaboration At The Grammys

?I would like to thank the swap meet for his hat,? as quoted by Jay-Z and directed towards The-Dream, was what the ether King Hov jokingly spat during his acceptance for his Grammy for Best Rap/Sung?Collaboration. ?No Church In the Wild,? the captivating intro from 2011?s Watch the Throne, granted Jay-Z, Kanye West, Frank Ocean and The-Dream the win.

As previously stated, Jay-Z, The-Dream and Frank Ocean accepted the award in lieu of the G.O.O.D. Music frontman?s absence, who opted to travel throughout Brazil with Kim Kardashian instead.

?No Church In the Wild??faced stiff competition for the award, contending with Nas and Amy Winehouse?s ?Cherry Wine,? Flo Rida?s ?Wild Ones,? Rihanna?s ?Talk That Talk? and?John Legend?s ?Tonight (Best You Ever Had)? as fellow?nominees.

The?Best Rap/Sung?Collaboration Grammy was Jay-Z and Kanye West?s third statue of the night, having previously won two for their undeniable smash hit ?N***as In Paris.? This also happens to be Frank Ocean?s second Grammy of the night, which he won just minutes after accepting an award for Best Contemporary Album.

Hats off to those guys.

He also took down the pool record held by two-time Olympic gold medalist Mark Gangloff, who had owned the mark with a 1:47.63.

ECB holds rates, waiting for recovery to take hold

FRANKFURT (Reuters) - The European Central Bank held its main interest rate at a record low of 0.75 percent on Thursday, maintaining its policy in order to see whether an economic recovery sets in later this year or is derailed by the euro's rise.

The appreciation of the euro to a 14-month peak against the dollar and a 30-month high versus the yen prompted French President Francois Hollande to call on Tuesday for an exchange rate policy to protect the currency from "irrational movements".

The ECB does not have a exchange rate policy target but the currency's rise could slow the euro zone's economic recovery and delay discussion of an exit from the ECB's crisis policy mode.

The ECB left its main interest rate on hold for the seventh month running. It also left the interest rate on its deposit facility at 0.0 percent and held its marginal lending facility - or emergency borrowing rate - at 1.50 percent.

(AP) ? Gloria Estefan and her husband Emilio are hoping the rhythm is going to lead to Broadway.

The duo on Tuesday announced that they've teamed up with the Nederlander Organization to try to develop a musical based on their lives and take it to the Great White Way.

"We are very excited to share this story, which is based on hope, determination and the belief that with hard work and passion, our dreams can become our reality. Our music has been a true reflection of who we are, where we came from and the journey that has brought us to where we are today," Gloria and Emilio Estefan said in a statement.

The Estefans were both born in Cuba and together became musical luminaries, winning Grammy Awards and fans across the U.S. with crossover hits like "The Rhythm is Going To Get You," ''Conga" and "Words Get in the Way," in addition to helping the careers of other artists including Shakira, Ricky Martin, Jennifer Lopez, Marc Anthony and Jon Secada.

Their lives certainly are the stuff of drama. At age 14, Emilio Estefan fled Fidel Castro's Cuba to Spain and later Miami. He enrolled in night school, working by day in a mailroom, determined to bring his mother and brother here, and he eventually succeeded. He persuaded an uncle to lend him money for an accordion and formed a band, playing traditional Cuban tunes at local fiestas.

Soon, the group added a shy but charismatic singer named Gloria who would steal the heart of Estefan and audiences worldwide as part of the Miami Sound Machine. The couple would go on to have two children and a more than 30-year professional and personal partnership.

The couple launched the Bongos Cuban Cafe chain and are part owners of the Miami Dolphins. Frustrated with the limited attention given to Latin music at the Grammys, they pushed for a separate show dedicated to the broad breadth of Spanish and Portuguese music with the Latin Grammys

"I am thrilled to collaborate with Gloria and Emilio to see their amazing story come to fruition on the Broadway stage," Jimmy Nederlander, president of the Nederlander Organization, said in a statement. "The Estefans' journey of success, led by raw talent and passion, is captivating as it drove them from relative obscurity to global sensations."

The Nederlander Organization will be producing the new show in partnership with Bernie Yuman, who produced and managed Siegfried & Roy's show in Las Vegas. The creative team will be announced later.

Amazing Video of Blind Skateboarder Wows the Web

Skateboarding is an extreme sport that takes a tremendous amount of skill, balance, coordination, and fearlessness. Now the world is being introduced to skateboarder Tommy Carroll who has all of that, and then some. Carroll was born with retinal cancer, which left him blind at the age of 2. His lack of sight didn't keep him from his passions, whether it is playing the drums or hitting the halfpipes. He spent hours honing his skateboarding skills and learning to assess his moves by listening to the sounds of his wheels on different surfaces.

A video of Carroll on Vimeo has been viewed more than 500,000 times. It's part of the Dutch retailer Perry Sport's "Be Brave Be Safe" campaign to bring awareness to the importance of wearing protective gear while skateboarding. Says Carroll, "Everybody should know that everything happens for a reason, and that there is always a way to overcome an obstacle if you really want it enough." He plans to take the initiative one step further by setting up a skateboarding club to promote protective gear at Northwestern University, where he is a sophomore.

Do you know anyone who has overcome a physical obstacle? Let us know on Facebook page or by following us on Twitter @YahooTrending

Obama takes gun control campaign to Midwest

MINNEAPOLIS (Reuters) - President Barack Obama on Monday took his gun control campaign to Minneapolis, making a visible push for reform ahead of his State of the Union address in a state with an active hunting culture where efforts have helped curtail violence.

Obama wants to move quickly to pass laws before memories fade of the December mass shooting in Newtown, Connecticut, that claimed the lives of 20 children and six adults.

On January 16 he proposed requiring criminal background checks for all gun sales, including private sales; banning so-called assault weapons; and limiting ammunition magazines to 10 rounds.

Gun control efforts face an uphill climb politically in the face of a powerful pro-gun lobby and a strong U.S. tradition of hunting and gun ownership. A right to bear arms is constitutionally guaranteed to Americans.

An effort to ban assault rifles is seen as the toughest sell among the president's proposals in a country where many Americans see gun control as an infringement of their rights and an example of government overreach.

White House spokesman Jay Carney said Obama still supported the assault weapons ban despite lackluster backing on Capitol Hill, including from members of his own party.

"The president supports, as he long has, the reinstatement of the assault weapons ban," Carney told reporters on Air Force One on the way to Minnesota.

The state is emblematic of the challenges Obama will face in advancing gun control in Congress.

While Minnesota's two Democratic U.S. senators have said they are sympathetic to measures to curb gun violence, the National Rifle Association, the largest U.S. gun-rights group, has backed all four Republicans and two of the Democrats who represent the state in the House of Representatives, according to data compiled by the Center for Responsive Politics.

Obama's visit to Minneapolis, which in January hosted a regional gun summit led in part by Minneapolis Mayor R.T. Rybak, is the Democratic president's first trip outside of Washington to promote his gun violence agenda.

After the meeting, Rybak, a Democrat, called on Congress to amend or end restrictions on the ability of federal officers to share information about guns with local law enforcement.

He urged federal lawmakers to name a permanent director for the Bureau of Alcohol, Tobacco, Firearms, and Explosives, a post that has been vacant for almost 10 years. Obama is urging Congress to confirm his nominee to the post, B. Todd Jones.

    GUN REFORM STEPS

Minneapolis took steps in the mid-2000s to reduce incidents involving guns and juveniles after an outbreak of violent crimes.

Minneapolis police chief Janee Harteau and Hennepin County Sheriff Richard Stanek met with Obama and Vice President Joe Biden last week. Stanek is leading a group of Minnesota sheriffs pushing for stronger background checks in the state.

"Minneapolis is a city that has taken important steps to reduce gun violence and foster a conversation in the community about what further action is needed," a White House official said, speaking on condition of anonymity.

The Newtown massacre mobilized support for measures to contain access to certain guns and ammunition. Obama has put Biden in charge of a push to get Congress to pass legislation that would make it harder for people who have criminal backgrounds or are mentally unbalanced to obtain guns.

The administration has included access to mental health and an examination of the effects of violent videogames as part of its efforts to stem gun violence.

Gun-control efforts have foundered in the past despite strong public support, in part because many gun owners believe advocates of gun control oppose owning and using firearms in general.

The White House last week released a photograph of the president firing a shotgun at a clay target, evidence that the he does in fact shoot for recreation, days after Obama's remark to an interviewer that he shot skeet on occasion evoked some skepticism.

Obama delivers his State of the Union address on February 12, and gun control is expected to feature prominently.

Nokia rolling out Windows Phone 7.8 for Lumia devices

Nokia has begun rolling out Windows Phone 7.8 for its Lumia devices running Windows Phone 7. According to a post on Nokia Conversations, the Lumia 510, 610, 710, 800 and 900 would be receiving the update.

To download the update, simply connect your phone to a computer via Zune for PC, or the Windows Phone app for Mac, and follow the instructions as shown in the video below.

Windows Phone 7.8 has the same homescreen as Windows Phone 8, and allows you to choose from three different tile sizes. There are also new options for the lock screen, such as a daily background image from Bing. Other features in the update include Internet Sharing, Bluetooth Sharing, imaging enhancements like Camera Extras, and apps such as Contact share, Play To and Nokia City Lens. Language support has also been expanded.

Microsoft had stated last year that none of the existing WP7 devices, including the Nokia 900, would be updated to Windows Phone 8. In order to avoid a riot outside their stores after it announced that, Microsoft promptly stated that Windows Phone 7.8?a sort of ?value pack?, if you will?would be rolled out for WP7 smartphones.

In an interview with The Verge at the time, Greg Sullivan, Senior Marketing Manager at Microsoft, stated, ?The nature of the investment [in Windows Phone 8] is primarily in areas that are not exploitable by existing hardware. To do the work to bring all of those elements to a platform that can't exploit them wasn't necessarily the most efficient use of resource.?

Lumia devices are finally getting the WP 7.8 update

    ?

While we understand that WP8 is a completely different beast altogether, it?s surprising that Microsoft couldn?t optimise it for single-core handsets. Perhaps the reason was the lower amount of RAM and not the CPU on the WP7 Lumia phones. However, not everyone cares about a dual-core CPU, NFC and all that jazz, so for them, the WP 7.8 update is more than welcome.

?When you pull that Lumia out of your pocket after you?ve received that 7.8 update, it will look and feel the same as a Windows Phone 8 device,? said Sullivan. This should keep many WP 7 users happy for the time being, until they decide whether to take the WP 8 plunge or not.

Explosion rocks Mexico state oil company

MEXICO CITY (AP) -- Mexico's state-owned oil company says 14 have died and 80 are injured in an office building explosion at its headquarters in the capital.

There was no immediate cause given for the explosion which occurred in the basement of an administrative building next to the iconic, 52-story tower of Petroleos Mexicanos, or Pemex.

"It was an explosion, a shock, the lights went out and suddenly there was a lot of debris," employee Cristian Obele told Milenio television, adding that he had been injured in the leg. "Co-workers helped us get out of the building."

The tower, where several thousand people work, was evacuated. The main floor and the mezzanine of the auxiliary building, where the explosion occurred, were heavily damaged, along with windows as far as three floors up.

"We were talking and all of sudden we heard an explosion with white smoke and glass falling from the windows," said Maria Concepcion Andrade, 42, who lives on the block of Pemex building. "People started running from the building covered in dust. A lot of pieces were flying."

A reporter at the scene saw rescue workers trying to free several workers trapped. Television images showed people being evacuated by office chairs, and gurneys. Most of them had injuries likely caused by falling debris.

Police landed four rescue helicopters to remove the dead or injured. About a dozen tow trucks were furiously moving cars to make more landing room for the helicopters.

In an earlier Tweet, the company said it had evacuated the building as a precautionary measure because of a problem with the electrical system in the complex that includes the skyscraper. It tweeted that several workers were injured.

Streets surrounding the building were closed as evacuees wandered around, and rescue crews loaded the injured into ambulances.

Interior Department spokesman Eduardo Sanchez confirmed that an explosion in a basement garage damaged the first and second floors of the auxiliary building, which is located in a busy commercial and residential area.

    Calls to Pemex went unanswered.
